TERMS & CONDITIONS

(1.) GENERAL

  • (1a.) At Moving Mountains Ski we want to ensure that you have as much fun as possible in a safe environment. Skiing and snowboarding are extreme sports and therefore carry an inherent risk of injury.
  • (1b.) We have taken every possible step to ensure that you have a completely safe and enjoyable experience through the use of appropriate equipment and the employment of a qualified and experienced team.
  • (1c.) It is mandatory that all customers complete and sign a disclaimer form agreeing to Moving Mountains Ski Terms and Conditions BEFORE they can begin lessons on our slopes.
  • (1d.) Moving Mountains Ski will not accept any responsibility for the death, personal injury or illness sustained by any visitor while on the premises due to negligence on the part of the visitor.
  • (1e.) Whilst we endeavour to maintain continuity of instructor in a series of lessons, this cannot be guaranteed.
  • (1f.) Signing our disclaimer is to ensure that the risks inherent in the sport of skiing or snowboarding are acknowledged (the signature of a parent or guardian is required for any participants under the age of 16).

(2.) FULL DISCLAIMER DETAILS

These details cover every use of Moving Mountains Snowsports Ltd (Moving Mountains Ski) facilities, all centres and all facilities run by Moving Mountains Ski including external events.

 

Risk Assessment:

  • (2a.) I understand that skiing and snowboarding are sporting activities that can lead to injury. Falling whilst skiing or snowboarding is a risk that one takes when participating in these sports and I accept that I am taking these risks.
  • (2b.) I understand that helmets MUST be worn. Moving Mountains Ski values mountain safety and actively promotes the wearing of helmets.
  • (2c.) I also understand and agree that the use of a Moving Mountains Ski slope, otherwise than in accordance with the instructors' instructions, may itself be hazardous and lead to injury.
  • (2d.) I understand and agree that whilst I am on the slope with my instructor, no other member of my spectating party will be allowed beyond the "NO ENTRY" retractable tape which prevents access to the stairs leading to either slope.
  • (2e.) Moving Mountains Ski requires a parent/guardian to remain onsite at all times while their child/children or charge(s) under 16 years of age are using the facilities.

Equipment:

  • (2f.) I understand that the Ski Boot Binding System is intended to release the boot from the ski when certain forces on the system reach preset values, but that it will NOT RELEASE OR RETAIN at all times where release or retention may prevent injury, and that it CANNOT prevent all injuries or guarantee the user's safety.
  • (2g.) I understand and agree that unwanted release or retention of bindings is an inherent risk of using any Ski Boot Binding System. I further agree and understand that any Ski Boot Binding System does NOT ELIMINATE the risk of injuries to the user's knees or to any other part of the user's body.
  • (2h.) If snowboard equipment is being supplied, I understand that these systems will NOT RELEASE in falls and accidents and that they do NOT protect against any type of injury.

Previous medical condition:

  • (2i.) I accept and agree that if I have any current or previous injury, which may be aggravated by skiing or snowboarding I will inform a member of staff before taking part in any activity offered by Moving Mountains Ski.

Photography:

  • (2j.) I agree to Moving Mountains Ski taking photos and video during the session and that these photos/videos may be used in promotional and training material. CCTV is in operation around the centre.

I further certify:

  • (2k.) that I am physically fit and able to take the strain and exertion involved in participating in Moving Mountains Ski activities;
  • (2l.) that I have informed a member of Moving Mountains Ski staff of any past injuries which may affect my participation in Moving Mountains Ski activities;
  • (2m.) that I have no medical condition that may be triggered or aggravated by participating in activities on the slope;

  • (2n.) that I am not under the influence of alcohol or any other intoxicating substance;

  • (2o.) that I will adhere to all safety regulations set out by Moving Mountains Ski staff members.

Disclaimer of liability:

  • (2p.) Moving Mountains Ski will have no liability to you under these arrangements (whether through use of equipment or of the slope) except (i) in respect of death or personal injury caused by the negligence of Moving Mountains Ski and (ii) for damage not exceeding £100 to your tangible property caused by the negligence of Moving Mountains Ski.

POLICIES

(3.) GIFT VOUCHERS

  • (3a.) It is the responsibility of the buyer to ensure all voucher recipients are eligible to participate in the purchased Lesson Format.
  • (3b.) All recipients must be the eligible Age, Shoe Size (if applicable) and be Fit To Participate (see below) unless stated otherwise by Moving Mountains Ski Staff.
  • (3c.) Where the recipient fails to meet the eligible criteria for the Lesson Format, then where possible, Moving Mountains Ski will help to transfer the voucher to a Format where the recipient(s) are eligible.
  • (3d.) All Gift Vouchers have no expiry date.
  • (3e.) Moving Mountains Ski reserves the right to ban anyone from our Gift Voucher Service if they are proven to be tampering with Gift Vouchers.
  • (3f.) All Gift Vouchers have no expiry date. 
  • (3g.) Moving Mountains Ski will not refund any Gift Vouchers.
  • (3h.) Gift Vouchers cannot be exchanged for cash.

  • (4c.) It is important that you speak to a member of Moving Mountains Ski if you are in doubt about your ability to participate in centre activities.
(5.) BOOKING POLICIES
  • (5a.) Please do not complete a booking until you have read and understood the terms and conditions.
  • (5b.) All prices include tuition, supervision, feedback provided by a qualified instructor and supply of all necessary equipment.
  • (5c.) You are welcome to bring and use your own boots and helmet, but all participants are required to use the specially prepared skis/snowboards provided by Moving Mountains Ski.
  • (5d.) All bookings  must be paid for, via phone, in advance.

  • (7b.) In the event of non-attendance (where a customer does not turn up for a session and has given no advance warning), the slot will be forfeited with no refund or reschedule option.
  • (7c.) Once a Progression Block has been started, it cannot be refunded in part or in full.
  • (7d.) If you need to cancel or re-book your session please call the reception team on: 01273 855 761
 

By Moving Mountains Ski:

  • (7d.) If for any reason Moving Mountains Ski is unable to provide the service promised for reasons beyond its reasonable control, we will endeavour to re-arrange your session. We will not, however, accept responsibility for any additional costs that may arise as a result of the situation being beyond our reasonable control.

(8.) GDPR AND CCPA COMPLIANCE:

  • (8a.) I confirm that I am at least 16 years of age or older
  • (8b.) I have read and accept any EULA, Terms and Conditions, Acceptable Use Policy, and/or Data Processing Addendum which has been provided to me in connection with the software, products and/or services. 
  • (8c.) I have been fully informed and consent to the collection and use of my personal data for any purpose in connection with the software, products and/or services. 
  • (8d.) I understand that certain data, including personal data, must be collected or processed in order for you to provide any products or services I have requested or contracted for.  I understand that in some cases it may be required to use cookies or similar tracking to provide those products or services.. 
  • (8e.) I understand that I have the right to request access annually to any personal data you have obtained or collected regarding me. You have agreed to provide me with a record of my personal data in a readable format. 
  • (8f.) I also understand that I can revoke my consent and that I have the right to be forgotten. If I revoke my consent you will stop collecting or processing my personal data. I understand that if I revoke my consent, you may be unable to provide contracted products or services to me, and I can not hold you responsible for that. 
  • (8g.) Likewise, if I properly request to be forgotten, you will delete the data you have for me, or make it inaccessible. I also understand that if there is a dispute regarding my personal data, I can contact someone who is responsible for handling data-related concerns. If we are unable to resolve any issue, you will provide an independent service to arbitrate a resolution.
